Legal or illegal, NumbersUSA gang doesn't care. They just want foreigners out. If they had their way they would stop immigration tomorrow. While other countries are increasing legal employment based immigration they're trying to shut it down here. They'll realize their folly only when it's too late.

I have got my EAD, and my application was filed in EB3, 2005 in perm.
With the kind of speed USCIS is working with, I fear I would never get my GC.
Whereas My brother is a Citizen. Can it be possible that he files family based GC for me ?
I have read that for family based applications they regard the priority date as date of filing I-130.
If I do so, will my current process be wiped off ?
what are the repurcussions.
Please advice.
It does not wipe out any thing. But PD for Brother/Sister of Citizens ( 4th Category) is 04/15/1998. EB3 is better then that. Just apply I-130 in case.

Did you write to the Ombudsman in form 7001 about 140 delay ( other thread ). I sent it yesterday. When did you file 140 at NSC ?

this is a standard reply when we enquire about a case.
I had enquired about 140 and got the same message. Then took an infopass and there the IO told there is nothing at 140 level and what I got is a standard reply .

I applied for my PERM Labor Certification on 06-Aug-2007. My status online shows "APPROVED"on 13-Aug-2007. My Lawyer says that the HARD COPY is needed to move forward (My priority date is Jan-2006 from a prior Labor/I-140 approval).
1. How long does it usually take for the Hard copy to reach the attorney's office after approval.
2. Is there any way I can apply for I-140/485 by August 17th given that my status shows "APPROVED" as of today (August 14th).
Any suggestions?

I am confused whether I made any mistake or the "state of Residence" says maharashtra based on consulate's state?

I agree - It's not a good thing. Moreover, it might push the wrong buttons if person from one state sends letters/faxes to the congressman from other state. I would not be surprised if the congressman would not care since you are not from his district. You can also check if you can send the letters/faxes to your state senators...

I have a friend that has a BS in Computer Engineering, and a MS in Electrical Engineering.
Can you guys give me sample job description that will qualify for EB2. He has 3 years of experience but that was acquired before obtaining the degrees.
Company is really flexible with job description.

I don't think it matters when the experience was acquired as long as it is related to the job description and it is verifiable. If for some reason those three years cannot be used, you can have a job requirement as something like MS in EE/CS + 0 years experience.

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.
The PERM is already denied and you can not get the extension based on the denied PERM.

I will get my H1B this October. How long should I stick with the same company before transferring? I read somewhere that I should stick with them for atleast 3 months after Oct 1st. Is this true?
I don't think there is any hard and fast rule. But you need at least a couple of pay stubs to show that you worked for this company. I am not a lawyer , seek professional help when in doubt.

On page towards the bottom it prompts the doctor to enter details of the tb skin test.
Did u actually take the test? If you did, then perhaps ur doc missed it.
If i remember correctly, the doc i went to gave us two copies of the form, one that was sealed for uscis and the other for our reference. Anyway, if they dont have a copy of it, get a new one and make sure this info is filled out and any attach any additional relevant doc and send it to uscis.
If u got a lawyer, i suggest you get them to send the info with an attached letter etc.

i took my passport pics from walgreen....i told them passport size photos...i got my renewed passport without any problem.
