I got my I-140 (EB3) approved with the priority date of November-2004.
I applied another Labor (EB2) in Feb 2007. When applygin for I-140 for this labor, my lawyer forgot to use the approved I-140 for getting the old priority date (Nov 2004 priority). So, I got the I-140 approval for EB2 case with Feb 2007 Priority date.
Now, can the lawyer change the priority date on the I-140 (EB2) to Nov 2004 using the previous I-140.

yes. you can. Just DON'T cancel. Keep them suspended. You have your utilities also suspended in the same way for much lesser fee.

As far as I know, I think you need an approved I-140 before you can use AC21.

You are safe. Once you have reached I-485 stage, it is all about you and not your employer. You mentioned that you already changed to a new employer. Technically, your old employer should've revoked your old I-140 after your move. Since, you moved to a new employer you are indicating that your new employer also has a new job that matches your initial Labor application. You have nothing to worry about your old employer closing down.

Technically you have to wait till Aug 1.
Chances are, you will get your GC sometime in early August :)

Hi I am a Physical therapist on H4.
company A wants to sponsor my h1. I have physical therapist license from STATE A and Letter from State B that they do not issue license without ssn no ( and i have letter from credentialing body also saying i meet all requirements for licensure for STATE B,I also have visa screen and other required documents.
can company A file An H1 with multiple LCAS - 2 states, so H1 is issued for 3 years
What service centre would the application go to-the one for which i have license of the one for which i have letter from board (ssn needed for license).
Once the h1 is approved can i work in any of the 2 states.
How long is the H1b taking to get approved if filed in regular processing and say no rfe is recieved
What problems could the approval face

My wife needs an EAD to apply for medical residency in the US. We have our EAD application pending (receipt date Aug 27th). We know we will get our EAD eventually. But the problem is more complex.
For medical residency, programs call candidates for interviews in Nov/Dec. So they start offering interview slots in Sep/Oct timeframe. If you don't have an EAD card or EAD-approval notice, they will not even consider you. They don't care if you say that EAD will definitely come by Dec (or something like that).
We tried our local congressman, but even he said he couldn't do anything
until the 90-day processing time had passed. We tried the local INFOPASS office and submitted an expedite request, but that got denied.
So we are urgently looking for ways to get my wife's EAD ASAP. If we don't get the EAD in time, my wife will lose an year and in medical residency, every year you sit at home counts (against you).
Does anyone here have any ideas what we can do ! Note: This EAD is needed for *education* purposes and not for *gainful* employment.

Graduated from college last year, finally found a job that I really like. Currently on OPT. Just curious to know how long will it take for employer to apply for labor and I-140.

I am hoping that with so many people stuck in the gc process, somebody has to fix it soon - and I (& other newcomers) will benefit from better immigration policy.

I got my receipt number for H1b application and its been more than a week but i still cannot check my status online on USCIS website.
It says case is not found ,even tried calling customer service .
Does it take time to get uploaded online ?
Did anyone else face this problem

Can i travel back to USA via London/UK without a valid US visa but with a valid AP?
London is kind of picky to make sure we have a valid US visa when traveling via their country and have to change planes.
My friend was coming back to USA via Emirates (Dubai/London/USA) and he was prevented to board the Dubai to London segment because he did not have a valid USA visa and they were not considering the AP documents.
Flew in on BA via London using my AP in February and everything was fine. They all know what an AP is. But I hope you are aware that you are required to have a UK transit visa since you do not have a valid US visa; just an AP. That's approx $92 per visa.
Or you can perform a search on these forums for a thread that listed the airlines (countries, actually) that do not require you to have a transit visa if you are reentering US on a AP.

As far as I know, there is no grace period. USCIS may choose to ignore a reasonable gap or may approve without I-94. Dont worry about that for now. Talk to friends/family and others and just find someone to sponsor. But if you are not able to find someone to sponsor even after few weeks, you will have to leave US. Sorry mate and Best of Luck.. just be quick and you will fine

I have a query related to entitlement of salary and back wages. I was laid off by a big MNC software company based in Texas in Oct 2009 . Just in span of 1 week , i was offered a position by desi consulting company starting November 1 . They started my H1 transfer process stating starting date as November 1 on LCA petition . I was told to wait until H1 receipt comes and client gives green signal to start the project.
Even after getting the receipt on 30th November , i was never sent on project neither paid .
I waited till 31st December and left the country on 1st Jan 2010.
What are my rights ? Am i entitled to get the back wages as stated on LCA petition because i was never paid by employer till date ?
What is the duration period i could get the salary ?
Please let me know the process to get my pending salary if i am entitled to get any

Pop star Lily Allen has had her US work visa cancelled after arriving at Los Angeles International Airport.
The 22-year-old, who is due to tour America in September, had flown in for the MTV Video Music Awards launch.
A spokesman for the singer said: "She's still in America. All her commitments will carry on as normal. The work visa will be sorted out by her next visit."
She was held at the airport for five hours in connection with an arrest for an alleged assault in London in June.
The arrest arose from an incident outside a London nightclub in March and resulted in a caution for common assault.
She flew into the US from Australia on Sunday to attend Tuesday's announcement of the award nominations in Las Vegas.
An MTV spokesperson has confirmed the star will still attend the awards show.
"Lily was questioned and her work visa was revoked," Allen's spokesman said. "She was detained for five hours but not strip searched. Understandably she was upset by it."
Allen will need a new work visa before she returns to the US on 6 September, when she is due to play in San Diego.
In a statement the singer said: "I am trying everything I can to sort this out.
"It is my intention to play my American dates in September. This depends on the authorities granting me a new work visa.
"I want my fans to know that I will do everything I can to be back in America in September. I don't like letting my fans down and this is a situation that I am sure we can sort."

I found this really old post 11 2004. I saw your tutorial for coloring code. I am need a coloring page for www.walrusdogblues.com My fantasy is to have five colors red blue and yellow black and white. and the ability to drop them in the drawings as needed to blend the colors. I have used TataAIG insurance from India on 4-5 occasions for my in laws and my parents and I found it to be good. On one occasion we also got around $4000 reimbursed from them (in Indian Rupees) for the hospital expenses incurred for my in laws. Here is my take on the Visitor Insurance.
You have two options -
1> Get visitor medical insurance from USA (various company names are at www.samachar.com).
Advantages - Dont have to pay money upfront for hospital charges, but its kinda expensive then insurance from India.
2> Get visitor medical insurance from India
Advantages - this can cover insurance when in-flight also and for luggage also.
Disadvantages - Might have to pay money upfront for hospital expenses, and get reimbursed back in India.
Please note that this can be different from vendor to vendor. Also any existing ailments are not covered.

my new company filed h1 transfer on premium on 17 of jan and got fedex delivery on 18th .I have to join this company asap..so I have few question
1. can i join this company even the receipt is not available?
2. how long its take to get the receipt and approval in premium processing?
3. is there any chance to denied if yes what are those factors if any one come accross?
